Glaser Weil Prevails in Longstanding Constitutional Takings Litigation for the County of Los Angeles

Glaser Weil secured a decisive victory for the County of Los Angeles in two high‑stakes constitutional challenges—Casa Greene and GHP Management—brought by landlord groups seeking tens of millions of dollars in alleged damages arising from the County’s COVID‑19 eviction moratorium.

The cases, originally filed in 2020 and 2021, asserted regulatory and physical takings and Contracts Clause claims, alleging that eviction protections enacted between March 2020 and March 2023 were unconstitutional. These two matters represented the final—and largest—remaining cases after Glaser Weil had already successfully defeated similar challenges to the same moratorium.

After years of intensive litigation, including extensive motion practice on the pleadings, mass discovery and a prior trip to the appellate court through the writ process, the Superior Court issued final judgments sustaining the County’s demurrers without leave to amend, ending the litigation.

The matters were led by Litigation Partner Jesse Levin, with significant contributions from Associate Jake Ragan, who played a key role and developed deep subject‑matter knowledge of the statutory and constitutional issues central to the cases.

With this win, Glaser Weil has now prevailed in more than six constitutional challenges brought by landlords and trade groups against the County of Los Angeles, successfully preventing injunctions and avoiding major potential damages exposure.
