Glaser Weil Secures Settlement for Caydon in High-Profile Litigation with San Diego City Attorney’s Office

Glaser Weil successfully represented Caydon San Diego Property LLC and affiliated entities in a complex and closely watched high-profile litigation brought by the San Diego City Attorney’s Office concerning the historic California Theatre property, located in the downtown core of San Diego. Following years of legal proceedings and negotiations, the City has agreed to dismiss its lawsuit, marking a significant resolution for our client.

The case centered on a century-old property that has remained vacant for more than 30 years and was designated by the City as a public nuisance. The City sought substantial damages and the immediate demolition of the structures. Glaser Weil defeated multiple motions by the City, including applications for Temporary Restraining Orders and a Preliminary Injunction, and secured a large attorneys’ fees ruling in federal court in the process.

City Attorney Heather Ferbert announced the settlement on August 20, 2025, which has drawn widespread media attention in San Diego and beyond.

The matter was led by Litigation Partner Elizabeth Sperling, with key contributions from associates Alexander Miller, Alaina Bird and Jacob Yang. We are pleased to have guided the client through this challenging litigation and to have helped achieve an outcome that is viewed as a significant and positive development for both the property and the broader community.
