As reported in a Law360 article titled “Marilyn Monroe Homeowners Sue LA Again Over Landmarking,” Glaser Weil represents clients Brinah Milstein and Roy Bank in newly filed federal litigation challenging the City of Los Angeles’ historic‑cultural monument designation of the Brentwood property they own where Marilyn Monroe once lived.

A team led by Peter Sheridan filed suit in the U.S. District Court for the Central District of California alleging that the City’s landmark designation has deprived the owners of all economically viable use of the property and amounts to an unconstitutional taking without just compensation. The designation has left them unable to demolish or improve the deteriorating structures on the site, while also subjecting the property to increased trespassing, security breaches and tourism‑related impacts. The complaint seeks injunctive relief or, alternatively, compensation under the Fifth Amendment.

Glaser Weil represents the property owners in the litigation, alongside co-counsel from Latham & Watkins and Pacific Legal Foundation. The federal complaint names the City of Los Angeles and Mayor Karen Bass as defendants and remains pending.
