Overview

Andrew J. Schuyler is an associate in Glaser Weil’s Employment Practice. He advises employers, investors and high‑net‑worth individuals on a broad range of employment matters, including complex employment disputes, day‑to‑day advice and counseling, employment‑related due diligence in corporate transactions and workplace investigations.

His industry experience spans technology companies and startups; venture capital and private equity sponsors and their portfolio companies; financial services and investment advisers; family offices and other closely held businesses; and a wide range of operating companies, including hospitality, staffing, healthcare and research, manufacturing and industrial, logistics and transportation, property management and commercial services, as well as restaurant operators.

In his litigation practice, Andrew represents employers and employees throughout all phases of litigation, from initial case assessment through discovery, motion practice and resolution. His litigation experience includes defending claims of discrimination, harassment, retaliation, wrongful termination, failure to accommodate, wage and hour violations, breach of contract and enforcement of restrictive covenants. He regularly prepares position statements and manages responses to charges before the EEOC, the California Civil Rights Department and other federal and state agencies. Andrew has additional experience conducting workplace investigations. He develops investigation plans, conducts witness interviews, evaluates evidence and prepares neutral, defensible memoranda and reports for employers.

Prior to joining Glaser Weil, Andrew practiced at a Chicago‑based national boutique and previously gained experience at a leading national employment law firm and an international law firm.

Andrew earned his J.D., magna cum laude, from the University of Illinois College of Law, where he served as Production Editor for the Journal of Law, Technology & Policy and as President of OUTLaw. He also received the award for CALI Excellence for the Future Award in Employment Discrimination. While in law school, he also interned for the Honorable Bernice B. Donald of the United States Court of Appeals for the Sixth Circuit. He earned his B.S. in Biology from the University of Central Florida and is an Eagle Scout.

LITIGATION AND INVESTIGATIONS

Andrew’s notable litigation experience includes his representation of:

  • Major American IT companies in a trade secrets and restrictive covenant dispute arising from a former executive’s declaratory judgment action in the United States District Court for the District of Nebraska, including the drafting of a motion to dismiss or, in the alternative, to transfer, and related briefing seeking to compel arbitration and enforce the Delaware forum selection clause.*
  • The U.S. arm of a global financial services company in an employment discrimination matter in the United States District Court for the Northern District of Illinois, including drafting and filing a partial Rule 12(b)(6) motion to dismiss and supporting memorandum briefing threshold issues, including administrative exhaustion and statutory pleading defects.*
  • A university and one of its associate professors in an appeal in the United States Court of Appeals for the Seventh Circuit, including briefing in defense of summary judgment on claims arising under the Rehabilitation Act and 42 U.S.C. § 1983 following proceedings in the United States District Court for the Northern District of Illinois.*
  • A company that manufactures and distributes medical and surgical products in an employment discrimination matter in the United States District Court for the Northern District of Illinois, including drafting motions to dismiss and for summary judgment based on the evidentiary record, which the parties resolved before the summary judgment motion was filed.*
  • A diversified media company and leading provider of local news and sports in an arbitration administered by Judicial Arbitration and Mediation Services (JAMS), including managing discovery and witness development, drafting key briefing (including summary disposition), preparing motions in limine, and supporting hearing preparation and witness examinations.*
  • One of the world's largest global diversified natural resource companies in a series of personal-injury tort cases arising from operations at an alumina refinery in the U.S. Virgin Islands in both the District Court of the Virgin Islands and the Superior Court of the Virgin Islands, including expert deposition designation work, trial subpoena preparation, and pretrial motion support across multiple consolidated and single-plaintiff matters.*
  • A leading North American online grocery platform in an administrative charge before the United States Equal Employment Opportunity Commission (EEOC) alleging race discrimination and retaliation, including factual development, chronology building, and drafting the employer’s position statement submission.*
  • A leading SaaS platform in investigating and resolving workplace complaints involving discrimination, harassment, retaliation and other workplace issues. Developed investigation plans, conducted witness interviews, assessed evidence and drafted neutral, defensible memoranda and reports.*
TRANSACTIONAL

Transactional experience includes Andrew’s advising on the employment aspects of the representations of:

  • A family office in its acquisition of two commercial design and office furniture companies.*
  • The funding arm of major tech-enabled services provider in its acquisition of a leading onsite outsourcing and staffing company and its security-focused division. Subsequently represented the company in its equity sale to a lower-middle-market private equity firm.*
  • A private equity firm in its asset purchase of a North Carolina manufacturing company.*
  • Venture capital firms and portfolio companies on employment-law issues throughout the investment lifecycle, from diligence and equity plan review to post-closing integration and compliance across jurisdictions.*

Representative experience includes Andrew’s representations of:

  • Employers, investors and portfolio companies with advice and counsel on all aspects of employment law, including compliance counseling, contract drafting, workplace investigations and risk management.*
  • California employers on compliance with California employment laws, including wage and hour, classification, restrictive covenant and handbook issues; reviewed pay practices and policies for compliance with the California Labor Code, Wage Orders and local ordinances; analyzed wage statements, overtime calculations and meal- and rest-period practices; and drafted and negotiated California-compliant employment-related agreements.*
