Glaser Weil is pleased to announce a triumphant win on behalf of its client Blaze Mobile. The firm is representing Blaze Mobile, a minority owned company, and its founder/CEO, Michelle Fisher, in a action by Samsung for a declaration of non-infringement relating to eight Blaze patents in the mobile payment and non-browser based app space.
Samsung filed eight petitions for Inter Partes Review (IPR) in the Patent Trial and Appellate Board (PTAB) challenging the validity of eight Blaze Mobile patents. Blaze filed Patent Owner Preliminary Responses in each IPR, arguing that the matters should not go forward because Samsung failed to establish a likelihood of invalidity as to any challenged claim. The PTAB agreed and declined to institute any of the IPRs, effectively ending Samsung’s invalidity challenges.
Glaser Weil’s victories on every one of the eight petitions at the institution stage provided a rare early ending to the PTAB proceedings.
