Joyner questioned whether absolute U.S. sales numbers instead of percentages should be the extraterritorial determinant, and regardless, said the focus is “to prevent consumer confusion and protect mark owners from those who trade on and harm their goodwill, both of which are implicated by petitioners’ conduct.”
