- Successfully representing a major utility in cost recovery litigation against numerous oil companies and industrial companies. The case was resolved by payment to Mr. Avchen's client of all costs and attorneys' fees.
Toxic Tort Litigation
- Representing a major industrial defendant in the coordinated groundwater cases pending in Los Angeles County. He has also successfully represented many other defendants in the San Fernando Valley Toxic Tort Litigation and has been involved in numerous toxic tort cases throughout the years.
Complex Environmental Settlement
- Representing a Forbes 100 company in a settlement involving an environmentally impacted property valued in excess of $200 million.
- Representing one of the major potentially responsible parties in negotiating and reaching an agreement with the EPA and local water purveyors in one of the largest and most innovative clean-up efforts of its kind.
- Successfully sued the Department of Defense on behalf of his client to recover money that the client had to spend cleaning up a site contaminated with perchlorate, a rocket fuel. By way of Stipulated Judgment, the Department of Defense paid Mr. Avchen's client $38.75 million based on a novel theory under CERCLA.
- Representing a large company in the negotiation of a settlement with both the Environmental Protection Agency and the Regional Water Quality Control Board in one of the largest Superfund sites in the country. The settlement resolved all outstanding liability on behalf of the client.
- Currently representing a major oil company in litigation to recover millions of dollars in clean up costs in Santa Maria, California.
