Associate

Thomas P. Burke Jr. is an Associate in the Firm’s Intellectual Property Group.

His practice focuses on intellectual property litigation, especially copyrights and patents, and he has represented clients on matters involving computer software, medical devices, and telecommunications technologies in federal courts and before the Patent Trial and Appeal Board.

He has extensive experience managing written discovery, preparing fact and 30(b)(6) witnesses for depositions, and examining both fact and expert witnesses at deposition and trial. Mr. Burke is also experienced in drafting motions and briefs at both the trial and appellate level.

Mr. Burke has represented clients ranging from independent sound designers to A-list acting talent, hedge funds to hardware manufacturers, and medical device companies to international airlines.

    • Managed copyright litigation docket for online retailer that was the frequent target of copyright "troll" lawsuits; negotiated with opposing counsel to defeat or settle cases at an early stage; supervised an active docket of over a dozen federal cases.

    • Represented wealthy investor in multimillion dollar dispute over video game development agreement; managed discovery; prepared deposition outlines and kits for several witnesses; took 30(b)(6) and fact depositions; drafted and negotiated jury instructions and other pretrial documents.
