Partner

Kenneth R. Whiting, Jr. is a Partner in the firm’s San Francisco office, with a practice focused on commercial real estate. He has 30 years of experience in a broad spectrum of real estate transactions, representing owners and developers in the acquisition, development, financing, leasing and disposition of commercial and industrial properties, and assisting both borrowers and lenders in secured and unsecured loans. In addition, he has special expertise in matters involving railroad property, pipelines, fiber optics, project finance, ground lease finance, sports and entertainment venues, and tech and biotech office and R&D leasing. While not a litigator himself, Mr. Whiting also regularly provides strategic advice to clients involved in adversarial matters.

Mr. Whiting served as a member of the Executive Committee of the Real Property Section of the State Bar of California from 2009 - 2011, and as an Advisor from 2012 - 2014. He maintains an active pro bono practice advising several Bay Area non-profit corporations and their grantees on real estate and business matters.

    • Represented a Class 1 railroad in connection with the expansion of a major intermodal facility in Lathrop and in connection with the purchase and subsequent sale of approximately 160 acres of land in Fremont.

    • Represented a foreign bank in connection with secured financings involving real property located in Texas, Hawaii and California.

    • Represented a multi-family REIT in connection with the disposition of a $280 million portfolio of 22 apartment properties located in Arizona, New Mexico and Nevada.

    • Represented the purchaser of a note secured by a distressed mixed-use construction project in the mid-Market area in San Francisco.

    • Represented a Class I railroad in connection with the installation and construction of fiber optic and pipline systems in railroad right-of-way throughout the western United States.

    • Mr. Whiting also served as a member of the team representing:  (a) a major international sports and entertainment company in connection with the development of Staples Center, the construction loan for LA Live, and the financing for the Home Depot Center; (b) a major California landowner in connection with the perfection of development rights associated with a landmark 80,000-acre ranch located on the central coast in California; (c)  a major U.S. industrial company in connection with development of eight “peaker” power plants in the State of California; (d) a large U.S. manufacturing company in connection with a $4 billion secured financing involving 50 industrial plants located in 27 states; and (e) an investment bank in connection with loans secured by office buildings in California, Florida and Texas.
