Andriy Pazuniak is an associate in Glaser Weil’s Environmental and Energy Practice Group.  Mr. Pazuniak has represented and counseled clients in an array of environmental and land use matters, and has extensive experience litigating cases in federal and state court and in arbitration. 

Prior to joining Glaser Weil, Mr. Pazuniak was an associate at the New York City law firm Carter Ledyard & Milburn LLP, where Mr. Pazuniak litigated a broad range of environmental and commercial actions. 

Mr. Pazuniak graduated from Seton Hall University School of Law, magna cum laude, where he was a member of the Order of the Coif and received the Raymond Del Tufo, Jr., Constitutional Law Award.  Mr. Pazuniak was also an Articles Editor for the Seton Hall Law Review and his law review comment has now been cited by three federal courts of appeals, a state supreme court and a book.  As a member of the Impact Litigation Clinic, Mr. Pazuniak argued before the Second Circuit Court of Appeals and successfully obtained a reversal of a district court order dismissing a pro se litigant’s civil rights claim.

After graduating law school, Mr. Pazuniak served as a judicial clerk for the Honorable Susan L. Reisner of the New Jersey Superior Court, Appellate Division.  Mr. Pazuniak also interned for the Honorable Joseph E. Irenas of the U.S. District Court for the District of New Jersey while in law school.

    • Won summary judgment for an energy services company in a federal breach of contract action against the seller of an oil storage tank farm to enforce contractual warranties contained in the sale agreement pertaining to compliance with environmental laws and regulations.

    • Obtained dismissal of an environmental challenge against a proposed natural gas-fired combined cycle generation facility on behalf of a municipal electric provider.

    • Successfully argued against a claim for electronic-discovery costs in federal district court.

    • Won dismissal of a majority of a statutory claim for attorneys’ and experts’ fees for a municipality arising from its voluntary withdrawal of development plans.

    • Represented performing arts center in litigation over use of neighboring parkland.

    • Evaluated proposals for fossil-fuel-fired plants, renewable energy and energy storage facilities for a municipal electric provider.
