Aaron P. Allan, a partner in Glaser Weil’s Environmental & Energy Department, has a wide breadth of experience and expertise that allows him to effectively advise and represent clients in a variety of contexts. For more than two decades, Mr. Allan has litigated major matters on behalf of a diverse range of business entities, including significant environmental and insurance coverage cases, toxic tort cases and real property litigation matters.

Mr. Allan has long represented regulated water utilities accused of delivering contaminated drinking water and many other companies subjected to claims brought under CERCLA and other environmental laws. These representations have almost always involved complex insurance coverage issues, and Mr. Allan has successfully represented clients in obtaining full coverage for such lawsuits. Mr. Allan also provides advice and counseling on a variety of other environmental regulatory matters, including air permitting, asbestos, drum recycling, regulatory compliance and issues involving hazardous materials. He helps clients manage site remediation activities, and also advises banks and other parties concerning the liability risks associated with purchase or foreclosure relating to any environmentally contaminated property.

Mr. Allan enjoys music and film, plays guitar and piano, rides a mountain bike and likes to follow a variety of sports teams.

    • Represented a local government entity in connection with claims against an adjoining landowner. Mr. Allan was the principal negotiator and architect of a complex settlement involving more than 20 parties, including a defendant in bankruptcy, the trustee of that defendant's Chapter 7 bankruptcy estate, and the administrator of two defendants' probate estates.

    • Represented large, well-known oil companies in various lawsuits to determine who will pay for the cleanup of contaminated real property located in Central California.

    • Represented a real estate development company in a multi-million dollar tenant dispute concerning defective construction.

    • Environment

    • Providing advice and counseling to a client in connection with a regulatory enforcement by the California Air Resources Board.  The enforcement concerns allegations of excess emissions of volatile organic compounds.

    • Defending a client in a lawsuit that claims violations of Proposition 65 for alleged exposure to DEHP.

    • Representing aluminum and titanium forging company in defending against stormwater discharge allegations and Clean Water Act enforcement.

    • Representing one of the largest Chapter 11 debtors in the State of California in prosecution of numerous actions with respect to environmentally contaminated properties owned in Central California.

    • Representing major hotel developer in resolving air permitting issues for one of the largest hotel developments in the world.

    • Representing drum recycling company accused of criminal conduct and exposed to civil statutory penalties for violating environmental laws.

    • Representing the trust department of a large bank in resolving environmental remediation issues for properties being managed by the bank.

    • Twice represented separate regulated water utilities accused of delivering contaminated drinking water.

    • Represented water utility in cost recovery action against polluters for reimbursement of costs associated with cleaning up groundwater basin.

    • Representing water utility in proceedings brought to enforce environmental cleanup obligations relating to groundwater pumping and plume control.
